't been a formal -- yes, senator feinstein is passed legislation were offered legislation. it isn't really going to the process. they just had hearings. there are three major proposals and i'll give you a morning line as two where they stand. first is the idea of an assault weapons ban like we had for 10 years starting in 94. diane feinstein proposing that. that we'll have the hardest time passing. there are some indications the white house realizes that we'll have a difficult time. some more likely is a limit on the size of these high-capacity magazines that carey 30 rounds. 100 rounds. and i think there is a better chance that could get through. the thing that has the best chance is a greatly expanded were possibly even universal background check. arguments about the numbers but whether it's 20 or 30 or 40% a large number of gun sales in this country there is no check to see whether the person has a history of mental illness or criminal record. i think that has the best chance in fact the polls showed 90% of americans support that idea. >> speaking of that today during the super bowl may

leahy, i want a bill to come out of the committee. if dianne feinstein by the time it's through the judiciary committee, if she doesn't have her assault weapons, at least let her have an opportunity to offer this amendment. >> will you vote for it? >> oh,i don't know. frankly, and she knows, i haven't read her amendment. i didn't vote for the assault weapons last time because it didn't make sense. but i'll take a look at it. >> mayor, is senator reid doing enough to move this legislation? >> i believe he should read the amendment and listen to a former mayor, dianne feinstein, who stuck her finger in a bullet hole at a scene of a crime. that's what we see as mayors. in washington assault ban weapon, it's a political issue. here is how it sounds to me. my daughter will be teaching school next year. if somebody is in the horrible situation of shooting in that classroom, and they're forced to reload the gun, that may be my daughter's life, that may be your child's life. force people to reload. my god, if we can't do that, it's horrible enough about what is happening out here. stop

. >> what do you make of his point and many who are critical of what senator dianne feinstein has proposed, over the fact that we do have hundreds if not thousands of lawses on the books already. >> it's a legitimate point. they are not being forced. i asked markicle bethat, who is a big supporter of gun control. he said, i would like to see them enforced. he is not saying that everything the nra is saying is wrong. remember, this is a retired navy captain. me and gabrielle giffords had and have guns. but he says, that doesn't solve a lot of the problems. i thought this was one of the revelations, i don't think they have much of a chance of getting an assault weapons ban. there is a growing realization, it is not going to happen on capitol hill this year. i think there is much more of a support and push and chance for a element on the size of magazines and especially for an expansion of the background check. and the polls indicate, a lot of nra number members support the idea, with a history of mental illness, and if there is a criminal record, there should be a limit. the person who shot

think the hardest sell on the hill right now will be senator feinstein's all-out assault weapons ban she's introduced. that's going to be a hard sell to those conservative democrats who are up for re-election in 2014, senators like mark baggage of alaska, max baucus of montana. that's going to be the hardest sell. universal background checks i think is where the consensus is building, although the senate judiciary hearing on tuesday or wednesday, one of the things that happened was that the national rifle association said that is not something that they can get behind. so you know, they're definitely going to be scoring those votes. i think it's going to be a harder sell than maybe folks originally thought when it comes to universal background checks. >> let's take a look at what's happening in massachusetts. lauren, scott scott brown saying he's not going to run for the senate seat opened up by john kerry. wasn't that the best hope republicans had to get that seat? >> a poll came out showing he had a slight lead on the democrat's candidate, ed marquee. i think he really was one of the b
